These Terms govern your access to VerifiedAgent.com, including public insurance producer profiles, search tools, reviews, reports, and agent account features. By using the site, you agree to these Terms and the Acceptable Use Policy. If you do not agree, do not use the site. “VerifiedAgent,” “we,” and “us” refer to the operator identified in Section 17.
1. What the site provides
VerifiedAgent is an independent information and review directory. It is not a state insurance department, insurer, government agency, NIPR, NAIC, or a licensing authority. We do not sell insurance through the directory or verify that a particular policy is suitable for you. Unless expressly stated, an agent’s appearance, claim badge, search rank, review score, or profile information is not an endorsement, accreditation, guarantee of competence, or recommendation.
Profiles may combine state or other public licensing data, data from official or third party sources, information submitted by agents, and user contributions. Source records can lag, omit fields, conflict, or become outdated. Check current licensing, authority, appointments, and discipline directly with the relevant state insurance department before making a decision. “Claimed” means an account completed our site’s claim process; it does not mean the agent has been endorsed by a regulator or that every profile statement has been independently verified.
2. Eligibility and accounts
You must be at least 18 to create an account, claim a profile, submit a review, or use interactive features. Provide accurate information, keep account credentials and verification codes confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account. We may require reasonable identity or authorization checks before permitting changes to a profile or account.
An agent who claims a profile represents that they are the individual named or are specifically authorized to act for that individual. Claiming does not transfer ownership of the site’s underlying directory record or public licensing data. An agent must not claim another person’s NPN, use another person’s verification code, or misstate licensure, appointments, services, or affiliation.
3. Profile data and corrections
We may create and maintain unclaimed profiles using information lawfully obtained from public or authorized sources. Agents and other users may request correction of inaccurate information through the site’s reporting or contact tools. We may ask for supporting evidence, consult the licensing authority, mark information disputed, correct it, or remove particular fields while reviewing a request. A claim request alone does not require removal of accurate public licensing information.
An agent is responsible for submitted profile text, contact details, links, images, license claims, carrier relationships, and responses. Keep these current and comply with applicable insurance advertising, privacy, and licensing rules. Do not submit consumer policy files, health information, Social Security numbers, or other sensitive personal data in a public field.
4. Reviews and agent replies
A review must reflect the reviewer’s genuine firsthand experience with the identified agent. Reviewers must submit truthful information and may not review themselves, competitors for manipulation, or an agent they have not experienced. Reviews may display a first name and last initial, star rating, text, date, and an agent reply. The email address and security information collected for submission are not intended to appear publicly; see our Privacy Policy when available.
Email verification or an anti-abuse check confirms control of a channel or completion of a security step, not the truth of the review or identity of the reviewer. We may screen, delay, decline, label, investigate, or remove content under the AUP. We do not promise to publish every review, investigate every allegation, or delete a review simply because it is negative. We aim to apply content rules without conditioning publication on favorable sentiment. Agent replies must address the feedback professionally and must not expose a customer’s private information.
Any incentive, discount, or other material connection related to a review must be disclosed in the review. Do not offer compensation for a particular rating or to change or remove a negative review.
5. User content license and rights
You retain ownership of content you submit. You grant us a worldwide, nonexclusive, royalty-free license to host, store, reproduce, format, display, distribute, and use that content to operate, promote, secure, and improve the site, including showing profile information, reviews, and replies. This license continues as reasonably needed for backups, legal obligations, and content already shared, subject to applicable law and our removal decisions.
You represent that you have the rights needed to submit the content and that it does not violate others’ intellectual property, privacy, publicity, contractual, or other rights. We may use automated tools to generate profile summaries from available data; such summaries can be inaccurate and should be checked against the underlying source.
6. Permitted use and intellectual property
You may search and view the site for lawful personal or professional purposes consistent with these Terms and the AUP. Except for your own content and public facts, the site design, original text, software, compilations, and marks are owned by us or our licensors. No right to scrape, copy a substantial part of the database, resell site data, or use our branding is granted. Linking to a public profile is permitted if it does not suggest endorsement or misrepresent the page.
Third party names, logos, trademarks, and government records remain the property of their respective owners. Third party websites linked from profiles are outside our control; we do not endorse or guarantee them.
7. Prohibited uses and enforcement
The Acceptable Use Policy is part of these Terms. We may investigate violations, restrict access, remove content, suspend or terminate accounts, preserve evidence, and cooperate with lawful requests. We may take proportionate action without advance notice where needed to protect users, data, or the service. We may allow an appeal or correction request through our contact channel, but do not guarantee a particular outcome.
8. Search results and commercial relationships
Search ranking, filters, view counts, statistics, and review summaries may be incomplete or affected by data quality, technical limits, and methodology changes. If we introduce paid placement, sponsorship, lead generation, or other compensation that materially affects how an agent appears, we will identify it where appropriate. Nothing on the site creates an agent-client relationship with VerifiedAgent.
9. No screening or eligibility use
The site is intended for consumers researching insurance professionals. Do not use it as a consumer report or for employment, credit, housing, insurance underwriting, or other eligibility decisions regulated by the Fair Credit Reporting Act. We do not represent that the site meets requirements for background screening or consumer reporting. Contact the relevant licensing regulator for official records and any legally required process.
10. Privacy and communications
Our separate Privacy Policy should explain what we collect, use, retain, and disclose. You consent to service messages needed for registration, verification, review notices, reports, security, and account administration, subject to applicable law and available preferences. We may send an agent a report submitted through a “report to agent” option; submitters should avoid including information they do not want shared with that agent. Marketing messages, if any, are subject to applicable consent and opt-out requirements.
11. Disclaimers
The service is provided “as is” and “as available” to the extent permitted by law. We do not warrant uninterrupted operation, complete coverage of agents or states, error-free data, genuine identity of every contributor, specific search visibility, or any insurance outcome. Some jurisdictions do not permit certain warranty exclusions, so these exclusions apply only to the extent allowed.
12. Liability and indemnity
To the extent permitted by law, VerifiedAgent and its personnel are not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service. Our total liability for claims arising from the service will not exceed the greater of $100 or the amount you paid us for the service in the 12 months before the event giving rise to the claim. These limits do not apply where prohibited by law or to liability that cannot lawfully be excluded.
You agree to defend and indemnify us against third party claims arising from your submitted content, your breach of these Terms, or your unlawful use of the service, except to the extent caused by our own misconduct or prohibited by law.
13. Changes, availability, and termination
We may modify features and these Terms. Material changes will be posted with a revised effective date and, where appropriate, communicated by email or on the site. Continued use after the new terms take effect constitutes acceptance, unless applicable law requires a different process. You may stop using the service at any time; request account closure through the contact channel. Public records and content may remain where legally permitted or reasonably necessary for the directory, legal compliance, disputes, or backups.
14. Disputes and governing law
Before filing a claim, contact us and allow a reasonable opportunity to address the issue. These Terms are governed by the laws of Florida, without regard to conflict of laws principles, except where mandatory law applies. Courts located in Polk County will have jurisdiction over disputes, subject to applicable consumer protections. No arbitration agreement or class action waiver is imposed by this draft.
15. Severability and entire agreement
If a provision is unenforceable, the remaining provisions continue in effect. These Terms, the AUP, and policies incorporated by reference form the agreement regarding site use. Failure to enforce a provision does not waive it. You may not transfer your account or rights under these Terms without our consent.
16. Copyright concerns
Send copyright complaints to the contact below with enough information to identify the copyrighted work, the material and its location, your contact information, and the statements and signature required by applicable law. If we designate a DMCA agent, we will publish that agent’s current details and register them with the U.S. Copyright Office. This paragraph does not itself represent that a designation has been completed.
